1. Agreement to terms

By accessing or using SwimbaitDesigner.com ("the Site"), including the bait designer tool, mold generator, community features, and any related services (collectively, "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is operated by SwimbaitDesigner ("we," "us," or "our"). Payments are processed by Lemon Squeezy (Sold Through Link, LLC), which acts as the merchant of record for all purchases.

2. Eligibility

You must be at least 18 years old to create an account or make a purchase. By using the Service, you represent that you meet this requirement.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when creating an account and to update it as needed. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Products and services

4.1 Free tier

The free tier provides access to the parametric bait designer, parts library, and a limited number of STL exports as described on the Site. Free tier limits may change at our discretion.

4.2 Pro subscription

Paid subscriptions are billed monthly or annually through Lemon Squeezy. Subscriptions renew automatically until canceled. You may cancel at any time through your Lemon Squeezy customer portal. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing period.

Features included in each subscription tier are described on our pricing page and may be updated from time to time. We will notify active subscribers of material changes to their plan's features.

4.3 Digital mold downloads (per-mold purchases)

Per-mold purchases are one-time transactions. Once a mold file (STL) has been downloaded, the sale is final. No refunds are available for digital mold downloads, as the files cannot be returned.

4.4 Physical 3D printed molds

Physical mold orders are fulfilled by SwimbaitDesigner. We print, inspect, and ship molds to the address you provide at checkout. Delivery times are estimates and not guarantees. We are not responsible for delays caused by shipping carriers.

Refund policy for physical molds: If your mold arrives damaged or with a manufacturing defect that prevents it from functioning properly, contact us within 14 days of delivery. We will replace the mold at no charge or issue a full refund at our discretion. Refund requests for reasons other than damage or defect will be evaluated on a case-by-case basis.

Shipping: We currently ship within the United States. Shipping costs and estimated delivery times are displayed at checkout. Risk of loss passes to you upon delivery to the shipping carrier.

5. Intellectual property and license

5.1 Your designs

You retain full ownership of any bait designs you create using the Service. We do not claim any rights to your designs, exported STL files, or mold files.

5.2 Shared designs

When you share a design through the community features, you grant SwimbaitDesigner and other users a non-exclusive, royalty-free license to view, remix, and generate molds from your shared design. You may remove a shared design at any time, which revokes this license going forward, but does not affect molds already generated or downloaded from your design.

5.3 Our content

The Service, including its design, code, user interface, documentation, logos, and branding, is owned by SwimbaitDesigner and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

5.4 Commercial use

Free tier users may use designs and molds for personal, non-commercial use. Pro tier subscribers are granted a commercial license to sell baits produced from molds generated through the Service. This commercial license does not extend to reselling or redistributing the mold files themselves.

6. Community guidelines

The community features (shared designs, comments, forum) are subject to the following rules. You agree not to:

Post content that is abusive, harassing, defamatory, or hateful
Upload content that infringes on another person's intellectual property
Spam, advertise, or solicit other users
Post misleading information about designs or products
Attempt to circumvent the Service's features, limits, or security

We reserve the right to remove content and suspend accounts that violate these guidelines without notice.

7. Prohibited uses

You agree not to:

Use the Service for any unlawful purpose
Attempt to access other users' accounts or data
Interfere with or disrupt the Service
Use automated tools to scrape, crawl, or extract data from the Service
Resell access to the Service or share subscription credentials

8. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that designs created with the Service will produce functional molds or baits. Results depend on many factors outside our control, including printer settings, materials, plastisol formulations, and pouring technique. The parametric designer and mold generator are tools; the quality of the end product is your responsibility.

Physical molds are printed with care but may vary slightly in finish and dimensional accuracy. Minor layer lines, surface texture, and color variations inherent to 3D printing are not considered defects.

9. Limitation of liability

To the maximum extent permitted by law, SwimbaitDesigner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including lost profits, data loss, or business interruption, regardless of the cause of action.

Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless SwimbaitDesigner and its owners, employees, and agents from any claims, losses, or damages (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

11. Modifications

We may update these Terms at any time. Material changes will be communicated via email or a notice on the Site. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 5, 8, 9, 10, and 13 survive termination.

13. Governing law

These Terms are governed by the laws of the State of Montana, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of the State of Montana.

Account information: email address, username, and password when you create an account
Shipping information: name, street address, city, state, and zip code when you order a physical mold
Payment information: processed and stored by Lemon Squeezy (our merchant of record) and Stripe; we do not store credit card numbers or payment details on our servers
Design data: parametric settings, saved designs, and uploaded files when you use the designer tool
Community content: comments, forum posts, shared designs, and photos you upload

2.2 Information collected automatically

Usage data: pages visited, features used, time spent in the designer, and actions taken within the Service
Device information: browser type, operating system, screen resolution, and device type
Log data: IP address, access times, and referring URLs

We use Cloudflare for hosting, which may collect additional technical data as described in Cloudflare's privacy policy.

2.3 Cookies

We use essential cookies to maintain your session and preferences. We do not use third-party advertising or tracking cookies. You may disable cookies in your browser, but some features of the Service may not function properly.

3. How we use your information

We use your information to:

Provide and maintain the Service, including processing orders and delivering physical molds
Communicate with you about orders, account activity, and Service updates
Send transactional emails (order confirmations, shipping notifications) through Resend
Improve the Service based on usage patterns and feedback
Enforce our Terms of Service and protect against misuse
Respond to your support requests

We do not sell your personal information to third parties. We do not send marketing emails unless you have explicitly opted in.

4. How we share your information

We share your information only in the following circumstances:

Lemon Squeezy / Stripe: payment processing and order fulfillment as merchant of record
Resend: transactional email delivery (order confirmation, shipping notifications)
Shippo: shipping label generation and package tracking for physical mold orders
Cloudflare: hosting infrastructure, content delivery, and security
MailerLite: marketing emails, only if you have opted in to receive them
Legal requirements: if required by law, regulation, or legal process
Business transfer: in connection with a merger, acquisition, or sale of assets, with notice to you

5. Community and shared content

When you share a design or post in the community, the following information is visible to other users:

Your username
Your shared designs, including photos and design parameters
Your comments and forum posts

Your email address and shipping information are never displayed to other users.

6. Data storage and security

Your data is stored on Cloudflare's infrastructure (D1 database and R2 storage). We use encryption in transit (HTTPS) and follow reasonable security practices to protect your information. However, no method of electronic storage is 100% secure, and we cannot guarantee absolute security.

7. Data retention

Account data: retained as long as your account is active; deleted upon account deletion request
Design data: retained as long as your account is active; you may delete individual designs at any time
Order and transaction data: retained for 7 years for accounting and legal compliance
Community content: retained until you delete it or your account is terminated; we may retain backups for up to 90 days

8. Your rights

You have the right to:

Access the personal information we hold about you
Correct inaccurate information in your account
Delete your account and associated data by contacting us
Export your designs and data
Opt out of marketing communications at any time

9. Children's privacy

The Service is not intended for use by anyone under 18 years of age. We do not knowingly collect information from children. If you believe a child has provided us with personal information, please contact us and we will delete it.

10. California residents

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect and the right to request deletion. We do not sell personal information as defined by the CCPA.

11. International users

The Service is operated from the United States. If you access the Service from outside the United States, your information will be transferred to and processed in the United States.

12. Changes to this policy

We may update this Privacy Policy from time to time. We will notify you of material changes by email or by posting a notice on the Site. Your continued use of the Service after changes take effect constitutes acceptance.
